Why Mortgage Intermediaries Need Professional Indemnity Insurance

Mortgage advice and arrangement can expose a firm to allegations of unsuitable recommendations, inadequate explanations, application errors and failures to identify important product terms or restrictions.

Complaints may be made directly to the firm or referred to the Financial Ombudsman Service. A client may allege that unsuitable advice, incomplete information or an administrative error caused financial loss.

Directly authorised home-finance intermediaries are generally subject to the FCA's Professional Indemnity requirements under MIPRU, subject to any applicable exception or comparable guarantee.

Appointed Representatives should establish whether their appointed activities are insured under the arrangements maintained by their principal or network, and whether separate cover is required under their contract or for activities falling outside the appointment.

Professional Indemnity Insurance may respond to civil liabilities, defence costs and relevant Ombudsman awards, subject to the policy terms. It should not be described as automatically covering regulatory fines, penalties or every breach of an FCA rule.

Interest-Only Repayment Strategy

A broker recommends an interest-only mortgage but fails to explain or document the proposed repayment strategy adequately. At maturity, the client alleges that the advice was unsuitable and that the risks were not properly explained.

Early Repayment Charge

A client remortgages or redeems a mortgage without having been adequately informed of a substantial early-repayment charge. The client alleges that suitable alternatives or the financial consequences were not properly explained.

Unsuitable Recommendation

A broker recommends a mortgage without adequately assessing or recording the client's needs, circumstances and foreseeable affordability. The client later alleges that the recommendation was unsuitable and caused financial loss.

Limited-Panel Disclosure

A broker recommends a product from a restricted lender panel but does not explain the scope of its service clearly. The client later alleges that the recommendation was presented as a wider-market assessment and seeks compensation for the alleged additional cost.
